Your right of withdrawal

As a consumer you generally have fourteen days to withdraw from a distance contract without giving reasons (§ 11 FAGG, Austria). The period starts on the day the contract is concluded.

At SMS For U every purchase is a separate contract for a temporary phone number for receiving SMS for one service in one country. We provide it immediately. How you request immediate performance before buying, and when your right of withdrawal therefore ends early, depends on where you buy.

Buying on the website

On smsforu.app you pay for each phone number individually. Before every purchase you tick a box reading:

☐ I accept the Terms and the Privacy Policy. I want the number right away and know that this ends my right of withdrawal.

The box is not pre-ticked; without it the button showing "Continue to payment" and the price cannot be used. We record when you confirmed this and under which text version.

Your right of withdrawal ends under § 18 (1) no. 11 FAGG once we have begun performance with your express consent, you have acknowledged the loss of the right of withdrawal, and you have received from us a confirmation of the contract on a durable medium (§ 7 (3) FAGG). We send that confirmation to the email address you give during payment — we do not ask for an email address ourselves. If we receive no email address from the payment, we cannot send you the confirmation; you then keep your right of withdrawal for fourteen days. Write to us at robin@smsforu.app in that case.

Buying in the iPhone app

In the iPhone app you buy each phone number individually as an in-app purchase through the App Store; Apple processes the payment. Above the button showing "Activate" and the price, before every purchase, it says:

By tapping "Activate" you expressly ask us to start performance right away and acknowledge that your right of withdrawal for this order ends once it is carried out. Apple's purchase sheet then opens.

Apple sends you the confirmation of the purchase by email to the address of your Apple Account. Withdrawal and refunds for App Store purchases are handled by Apple under its own terms; you contact Apple for them. You request a refund through Apple's refund window, which the app offers you, or at reportaproblem.apple.com; how to withdraw towards Apple is set out in Apple's terms. If Apple asks us, we automatically tell Apple whether a code was delivered; Apple decides.

Buying in the Android app

In the Android app you buy each phone number individually through Google Play; Google processes the payment, and Google Play's terms also apply to it. Above the button showing "Activate" and the price, before every purchase, it says:

Google sends you the confirmation of the purchase by email to the address of the Google Account you buy with. Withdrawal and refunds for Google Play purchases are handled by Google under Google Play's terms and refund policies; you declare the withdrawal towards Google. If no code arrives, we also refund the purchase price through Google Play on our own initiative (see below).

No withdrawal needed: money back without a code

Independently of the right of withdrawal, for a phone number on which no code arrives:

Website: we refund the purchase price to the same payment method on our own initiative. You do not have to declare or request anything.
Android app: we refund the purchase price through Google Play on our own initiative. You do not have to declare or request anything.
iPhone app: only Apple can refund App Store purchases, and only at your request; for this the app opens Apple's refund window for you. If Apple asks us, we tell Apple that no code was delivered; Apple decides.

From about two minutes on you can also end the number yourself with "Cancel & refund", as long as no code has arrived. After ten minutes without a code it ends on its own.

How to withdraw

An informal, unambiguous statement is enough — for example by email to robin@smsforu.app or by letter to L&L Synergy FlexCo, Preradovicgasse 15, 1140 Wien. You may use the model form below, but you do not have to. Sending the statement before the deadline is enough to meet it.

Effects of withdrawal

We refund all payments received without undue delay, at the latest within fourteen days of receiving your statement, using the same payment method. It costs you nothing. After a withdrawal, an App Store or Google Play purchase is refunded by Apple or Google; how to request it is described under "Buying in the iPhone app" and "Buying in the Android app".
